Terms & Conditions
The legally binding version is the German terms (AGB).
§ 1 Provider and scope
The provider of betadomain.de is OnlineBuilders LLC, 131 Continental Dr, Suite 305, Newark, DE 19713, USA (the "Provider"). These terms apply to all contracts for the registration, management, renewal and transfer of domains and related services concluded via betadomain.de or the customer portal betadomain.de.
§ 2 Subject matter
The Provider brokers and manages internet domains. The actual allocation and administration is carried out by the responsible registry (e.g. DENIC eG for .de, Verisign for .com) or an upstream registrar; the Provider acts as a reseller. There is no entitlement to a specific domain; availability at the time of processing is decisive.
§ 3 Conclusion of contract
The presentation in the portal is not a binding offer. By submitting an order the customer makes a binding offer. The contract is concluded once the Provider confirms the order or provides the domain.
§ 4 Prices and payment
The prices stated in the portal at the time of ordering apply, plus any statutory VAT. Payment is processed via Stripe (Stripe Payments Europe Ltd. / Stripe, Inc.). Services are generally invoiced in advance for the respective term. In case of default, the Provider may suspend services.
§ 5 Term, renewal and termination
Domains are registered for the selected term (usually one year, sometimes two) and renewed automatically for the same term unless terminated in time before expiry. The applicable notice period follows the rules of the responsible registry and is shown in the portal. Termination can be made via the customer portal.
§ 6 Customer obligations
The customer warrants that the data provided (in particular holder and contact data) is complete and correct and keeps it up to date. The customer ensures that registered domains do not infringe third-party rights (trademark, name, copyright) or legal provisions, and indemnifies the Provider against third-party claims arising from unlawful use of the domain by the customer.
§ 7 Registry terms
By registering a domain the customer additionally accepts the applicable registration terms and policies of the responsible registry (e.g. DENIC domain terms, ICANN policies).
§ 8 Domain transfer
Incoming and outgoing transfers follow registry rules. A transfer usually requires an authentication code (auth code). The Provider supplies the auth code for outgoing transfers on request, unless legitimate reasons (e.g. outstanding payments, lock periods) prevent this.
§ 9 Suspension and termination for cause
The Provider may suspend a domain or terminate the contract for cause, in particular in case of payment default, incorrect holder data, unlawful use, or by order of the registry or a competent authority.
§ 10 Availability and maintenance
The Provider endeavours to provide high availability of the portal but does not owe uninterrupted availability. Maintenance and disruptions at registries or upstream providers may delay order processing.
§ 11 Liability
The Provider is liable without limitation for intent and gross negligence and for damage to life, body or health. For slight negligence, liability applies only for breach of an essential contractual obligation, limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. Mandatory statutory liability remains unaffected.
§ 11a Content under the domain, indemnification
The Provider acts as registrar/intermediary and does not itself provide any content under the domains. The Provider is not responsible and assumes no liability for content, data, applications, emails or services that the Customer or third parties publish, store or operate under a registered or transferred domain. The Provider is not obliged to monitor content accessible via customer domains or to investigate circumstances indicating unlawful activity. Upon specific notice of infringing content, the Provider acts in accordance with statutory requirements (notice-and-takedown); such notices should be sent to [email protected]. Sole responsibility and liability for the content and use of the domain rests with the Customer, who indemnifies the Provider against all third-party claims arising from content provided under their domain or its use (see also § 6).
§ 12 Right of withdrawal (consumers)
Consumers have a statutory right of withdrawal. For domain registration, the right of withdrawal expires early once the service has been fully performed, where performance began after the consumer expressly consented and acknowledged losing the right of withdrawal. Details are set out in the withdrawal policy.
§ 13 Data protection
See our Privacy Policy.
§ 14 Changes to these terms
The Provider may amend these terms with future effect where necessary to adapt to changed legal or technical conditions. Customers will be informed in good time; absence of objection within the stated period constitutes acceptance.
§ 15 Governing law and final provisions
Contracts between the Provider and the Customer are governed by the law of the State of Delaware (USA), excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. However, for consumers habitually resident in the European Union: this choice of law does not deprive the consumer of the protection afforded by the mandatory consumer-protection provisions of the law of their country of residence (Art. 6 Rome I Regulation). Should individual provisions be invalid, the remaining provisions remain effective.
